The purpose of this Policy is to set out the data protection and data processing principles applied by Kétkerék Info Kft. (the “Company”) and the Company’s data protection and data processing policy, which the Company acknowledges as binding upon itself, and undertakes to ensure that its data processing related to its services and the operation of its online stores complies with the provisions set out in this notice and in the applicable laws.
The Company’s data processing principles are in line with the applicable legislation on data protection, including in particular the following:
The legal basis for data processing on the website is the User’s consent, Section 5(1) of the Infotv., and Section 13/A(3) of Act CVIII of 2001 on Certain Issues of Electronic Commerce Services and Information Society Services.
The scope of this notice covers data processing carried out on the Company’s websites (https://blaster-ground.hu) and its subdomains. This privacy notice is continuously available on the website https://blaster-ground.hu.
Amendments to this privacy notice shall enter into force upon publication on the above website.
In the case of user registration, the personal data that must be provided are: e-mail address, first and last name, telephone number, date of birth, gender, nationality. The name of the user’s sports club may be provided optionally.
During the operation of the system, certain data are recorded for technical purposes: data of the user’s computer used for logging in, which are generated during the use of the service and recorded by the data controller’s system as an automatic result of technical processes. Such automatically recorded data are logged automatically upon login and logout without any separate statement or action by the user. These data cannot be linked with other personal user data, except where required by law. Only the data controller has access to these data.
Data processing is carried out on the basis of the users’ voluntary statements provided after receiving appropriate information. This statement includes the users’ explicit consent to the processing of the personal data they provide while using the website, for the purposes set out below. The legal basis for data processing is the data subject’s consent pursuant to Section 5(1)(a) of Act CXII of 2011 (Infotv.), and, where applicable, Section 13/A(3) of Act CVIII of 2001 on Certain Issues of Electronic Commerce Services and Information Society Services.
The purpose of data processing is to ensure the provision and operation of the services available on the website https://blaster-ground.hu, including in particular:
The purpose of automatically recorded technical data is to compile statistics, develop and operate the IT system, ensure security, and protect the rights of users.
The data controller may not use the personal data provided for purposes other than those described in this Policy. Disclosure of personal data to third parties or authorities is only possible on the basis of the user’s prior explicit consent, unless mandatory legal provisions provide otherwise.
The data controller does not verify the personal data provided. The person providing the data is solely responsible for the accuracy and appropriateness of the data provided. By providing an e-mail address, any user also accepts responsibility for ensuring that only they use the service from the e-mail address provided.
Personal data may only be processed on the basis of an appropriate legal basis (consent or another lawful basis). Personal data must be processed fairly and in a transparent manner in relation to the data subject. Information related to data processing must be provided in a concise, transparent, intelligible and easily accessible form, using clear and plain language.
Personal data may only be collected for specified, explicit and legitimate purposes. Further processing may only take place in a manner compatible with those purposes. In many cases, the balancing of the data controller’s and the data subject’s interests, directly related to the purpose limitation principle, may establish the legal basis for processing.
In accordance with the principle of data minimisation, data collection and data processing must be limited to what is necessary to achieve the intended purpose.
Inaccurate personal data must be erased or rectified without delay. Organisations are required to implement routine procedures to keep data up to date.
Personal data may be stored in a form which permits identification of data subjects only for as long as necessary to achieve the purposes of the processing. In the case of pseudonymisation, data cannot be attributed to a specific data subject without the use of additional information.
Appropriate measures must be taken to prevent unauthorised or unlawful processing of personal data, and accidental loss, destruction or damage. Data protection incidents (i.e. breaches affecting personal data) must be reported to the data protection authority where there is a risk that the rights and freedoms of data subjects may be affected. Where the risk is high, the data subject must also be informed directly.
Under the accountability principle (GDPR Article 5(2)), organisations must be able to demonstrate compliance with the above principles, supported by appropriate documentation.
Kétkerék Info Kft. processes the personal data that are strictly necessary for using its services on the basis of the data subjects’ consent, and solely for the specified purposes.
The Company, as data controller, undertakes to process the data it obtains in accordance with the provisions of the Infotv. and the data protection principles set out in this Policy, and not to disclose such data to third parties.
Exceptions to the above include the following:
As data controller, Kétkerék Info Kft. complies in all cases with the restrictions laid down by applicable laws when collecting, recording and processing data, and informs the data subject about its activities via electronic communication. The Company undertakes not to apply any sanctions against a user who refuses to provide non-mandatory data.
Kétkerék Info Kft. undertakes to ensure the security of data and to implement the technical and organisational measures and procedures necessary to ensure that the collected, stored and processed data are protected, and to prevent their destruction, unauthorised use or unauthorised alteration.
If personal data are inaccurate and the accurate personal data are available to the data controller, the data controller may rectify the personal data.
Instead of erasure, the data controller shall restrict the processing of personal data if the data subject requests this, or if, based on the information available, it can be assumed that erasure would harm the data subject’s legitimate interests. Personal data restricted in this way may only be processed for as long as the purpose that prevented erasure continues to exist.
The data subject must be informed of the rectification, restriction or erasure of personal data, and any recipients to whom the data were previously disclosed for the purposes of processing must also be informed. Notification may be omitted if it would not adversely affect the data subject’s legitimate interests, taking into account the purpose of the processing.
Duration of data processing
The processing of the personal data provided by the user shall remain in place until the user requests the deletion of their data via the profile menu within the service. Deletion is carried out through an automated process, during which the deletion request can be finalised via a link sent to the e-mail address provided at registration.
Alternatively, the user may request the deletion of their personal data by sending an e-mail to info@blaster-ground.hu, in which case the deletion will be completed within a maximum of 10 days.
In the event of unlawful or misleading use of personal data, or in the event of a criminal offence committed by the user or an attack against the system, the Data Controller is entitled to delete the user’s data without delay at the same time as terminating the user’s registration. However, in the event of suspected criminal activity or suspected civil liability, the Data Controller is also entitled to retain the data for the duration of the procedure to be conducted.
The personal data provided by the user — even if the user does not unsubscribe from the service — may be processed by the Company as Data Controller until the user expressly requests the termination of such processing by e-mail sent to info@blaster-ground.hu. A request to terminate data processing without unsubscribing from the service does not affect the user’s right to use the service; however, it may occur that certain services (e.g. the webshop) cannot be used without personal data. Data will be erased within 10 business days from receipt of the relevant request.
Data that are automatically recorded for technical purposes during the operation of the system are stored for a period that is justified for ensuring the operation of the system, calculated from the time such data are generated. The Company ensures that such automatically recorded data cannot be linked with other personal user data, except where required by law. If the user withdraws their consent to the processing of their personal data or unsubscribes from the service, the technical data will no longer allow the user to be identified.
Any change in personal data, as well as any request for the erasure of personal data, may be communicated by sending an explicit statement by e-mail to info@blaster-ground.hu.
Certain personal data may also be modified by the user by editing them on the page containing the user’s personal profile.
After a request for erasure or modification of personal data has been fulfilled, the previous (deleted) data can no longer be restored.
Kétkerék Info Kft. does not use a separate external data processor. The Company processes the personal data it handles itself.
Kétkerék Info Kft. does not carry out any profiling (i.e. it does not collect information that was not provided by the user).
The Company, as Data Controller, is entitled and obliged to transfer to the competent authorities any personal data in its possession that are lawfully stored by it, where the transfer of such data is required by law or by a final and binding decision of an authority. The Data Controller shall not be held liable for such transfers or for any consequences resulting therefrom.
If the Company transfers the operation or utilisation of the content service available on https://blaster-ground.hu to a third party, in whole or in part, it may transfer the data it processes to such third party for further processing without requesting separate consent. Such transfer may only serve the purpose of ensuring the continuity of registration for already registered users, and may not place the user in a less favourable position than the data processing and data security rules set out in the then-current version of this Policy.
In the case of issuing an electronic or handwritten invoice, the personal data included on the invoice (name, address, tax number) may be transferred to the official accounting firm performing the Company’s bookkeeping.
Kétkerék Info Kft. reserves the right to amend this Data Processing Policy at any time by unilateral decision, in a manner that does not violate applicable legal requirements.
Amendments may be introduced in order to reflect changes or developments in data processing activities, with the primary aim of providing a higher level of protection for users’ personal data, or to include clarifications (for example, changes to the registered office, or changes to a contractual partner).
Following an amendment to this Policy, the Company shall inform all users by e-mail sent to their registered e-mail address (except for minor changes of a purely clarifying nature). By continuing to use the service, users acknowledge and accept the amended data processing rules; no additional consent is required.
Users may request information about the processing of their personal data from the Company, as Data Controller, at any time in writing by sending an e-mail to info@blaster-ground.hu. The request for information may cover the user’s data processed by the Data Controller, the source of such data, the purpose, legal basis and duration of the processing, the name and address of any data processors, activities related to the processing, and, in the event of data transfers, the recipients of the personal data and the purposes for which they have received or will receive the data.
Users may request the erasure of their data by sending an e-mail to info@blaster-ground.hu, or by initiating the automated deletion process after logging in via the profile menu.
A request sent by e-mail shall only be considered authentic by the Data Controller if it is sent from the user’s registered e-mail address.
The Data Controller shall provide a written response to questions related to data processing as soon as possible, but no later than 30 days from receipt. The date of receipt shall be considered the first business day following the sending of the e-mail.
Pursuant to Section 6 of Act XLVIII of 2008 on the Basic Conditions and Certain Limitations of Economic Advertising Activities, the User may give prior and explicit consent for the Company to contact them at the e-mail address provided during registration with advertising offers and other informational messages.
Furthermore, taking into account the provisions of this notice, the User may consent to the processing of the personal data necessary for sending advertising offers.
